Policy

 

  1. Objective:(1)
    The purpose of this policy is to establish the commitment of Campbell and Kennedy Electric (1996) Limited in becoming more accessible for all individuals that may have a disability including employees and clients.

  2. Statement of Commitment: Campbell and Kennedy Electric (1996) Limited is committed to treating all people in a way that allows them to maintain their dignity and independence. Campbell and Kennedy Electric (1996) Limited believes in integration and equal opportunity. Campbell and Kennedy Electric (1996) Limited is committed to meeting the needs of people with disabilities in a timely manner, and will do so by completing the following goals:
    1) To meet Ontario’s accessibility laws,
    2) To remove accessibility barriers in accordance with Campbell and Kennedy Electric (1996) Limited’s
    multiyear accessibility plan,
    3) To prevent future accessibility barriers.

  3. Scope:
    This policy applies to Campbell and Kennedy Electric (1996) Limited and requires the input and cooperation of all Campbell and Kennedy Electric (1996) Limited employees.

  4. Definitions:(2)
    Accessible formats may include, but are not limited to, large print, recorded audio and electronic formats, braille and other formats usable by persons with disabilities; Communication supports may include, but are not limited to, captioning, alternative and augmentative communication
    supports, plain language, sign language and other supports that facilitate effective communications;

    Accessibility – the degree to which a product, device, service, or environment, is available to accommodate or assist an individual with a disability.

    Accessible Format – may include, but is not limited to, large print, recorded audio and electronic formats, braille and other formats usable by persons with disabilities.

    Assistive Device – a tool, product, or piece of equipment that assists an individual with a disability in performing certain tasks (e.g., wheelchair, adaptive or large font computer keyboard, etc.).

    Designated public sector organization means every municipality and every person or organization listed in Column 1 of Table 1 of Ontario Regulation 146/10 (Public Bodies and Commission Public Bodies — Definitions) made under the Public Service of Ontario Act, 2006 or described in Schedule 1 to this Regulation;

    Disability – AODA uses the same definition as the Ontario Human Right’s Code.
    a) Any degree of physical disability, infirmity, malformation or disfigurement that is caused by bodily injury, birth defect or illness and, without limiting the generality of the foregoing, includes diabetes mellitus, epilepsy, a brain injury, any degree of paralysis, amputation, lack of physical co-ordination, blindness or visual impediment, deafness or hearing impediment, muteness or speech impediment, or physical reliance on a guide dog or other animal or on a wheelchair or other remedial appliance or device,
    b) a condition of mental impairment or a developmental disability,
    c) a learning disability, or a dysfunction in one or more of the processes involved in understanding or using symbols or spoken language,
    d) a mental disorder, or
    e) an injury or disability for which benefits were claimed or received under the insurance plan established under the Workplace Safety and Insurance Act, 1997.

    Facilitator – a person who assists an individual with a disability in performing certain tasks that are difficult or not possible for that individual.

    Large designated public sector organization means a designated public sector organization with 50 or more employees;

    Large organization means an obligated organization with 50 or more employees in Ontario, other than the Government of Ontario, the Legislative Assembly or a designated public sector organization;

    Obligated organization means the Government of Ontario, the Legislative Assembly, a designated public sector
    organization, a large organization and a small organization to which the standards in this Regulation apply;

    Service Animal – For the purposes of this section, an animal is a service animal for a person with a disability,
    a) if it is readily apparent that the animal is used by the person for reasons relating to his or her disability; or
    b) if the person provides a letter from a physician or nurse confirming that the person requires the animal for reasons relating to the disability

    Small designated public sector organization means a designated public sector organization with at least one but fewer than 50 employees;

    Small organization means an obligated organization with at least one but fewer than 50 employees in Ontario, other than the Government of Ontario, the Legislative Assembly or a designated public sector organization. O. Reg. 191/11, s. 2; O. Reg. 413/12, s.

  5. Responsibilities of Campbell and Kennedy Electric (1996) Limited:(3)
    1) Employer
    a) Document all accessibility policies, practices, and procedures in writing and update as required,
    b) Provide all policies, practices, and procedure to an individual with a disability in an accessible format, if necessary,
    c) Train all existing and new employees on Campbell and Kennedy Electric (1996) Limited’s accessibility policy and
    changes to the policy as necessary,
    d) Respond to all feedback in relation to disability or accessibility from employees or clients within 14 days, including completion of an investigation and/or progressive disciplinary action, if necessary
    e) File AODA report on the required years with the government.
    Private or non-profit organizations with 50 or more employees or public sector organizations – below
    e) Develop, maintain, and update a multi-year accessibility plan to reach accessibility goals as required by law,
    f) Develop, maintain, and update Campbell and Kennedy Electric (1996) Limited’s website to meet accessibility
    requirements as required by law,
    g) As required report progress on Campbell and Kennedy Electric (1996) Limited’s multi-year accessibility plan to the applicable governing body prior to each established deadline,
    h) Continue to be informed of future compliance requirements and update Campbell and Kennedy Electric (1996) Limited’s multi-year accessibility plan as required,

    2) Employees
    a) Inform Campbell and Kennedy Electric (1996) Limited’s employer if assistive devices or formats, facilitators, service animals, and/or individualized emergency response information is required to perform work safely.
    b) Provide input to Campbell and Kennedy Electric (1996) Limited’s multi-year accessibility plan as required,
    c) Attend training sessions on accessibility in the workplace,
    d) Adhere to policy requirements in regards to accessibility in the workplace (e.g., communication, customer service, etc.).

  6. Accessible Formats and Communication Support:(4)

    Campbell and Kennedy Electric (1996) Limited is committed to meeting the communication needs of all individuals with disabilities. Campbell and Kennedy Electric (1996) Limited shall take into account accessible formats for communicating information to an individual with a disability (e.g., written, spoken word, etc.). This information includes any information
    that is needed to perform a job, or information that is generally available to an employee at Campbell and Kennedy Electric (1996) Limited.

    Employees must:
    1) Use person-first language when speaking of or to an individual with a disability if necessary to the conversation. Person-first language considers the individual before his or her disability (e.g., saying “the person who is blind” rather than “the blind person”).
    2) Not make assumptions about an individual’s disability. Allow the individual to describe the limitations imposed on them by their disability themselves.
    3) Never refer to someone as ‘handicapped’, ‘retarded’, ‘lame’, or any other inappropriate description of an individual’s disability.

  7. Recruitment of Employees with Disabilities:(5)
    Campbell and Kennedy Electric (1996) Limited will notify applicants that accommodations for disabilities are available upon request. If an applicant requests accommodation, Campbell and Kennedy Electric (1996) Limited will provide or arrange for suitable accommodation or support taking into account accessible formats. Campbell and Kennedy Electric (1996) Limited will provide updated information to employees whenever there is a change to existing policies due to the
    provision of accommodation.

  8. Accessible Emergency Information:(6)
    Campbell and Kennedy Electric (1996) Limited is committed to providing employees and clients with publicly available emergency information in an accessible format upon request. Any employee with a disability will be provided with individualized emergency response information when necessary if Campbell and Kennedy Electric (1996) Limited’s is made aware of this need.

  9. Individual Accommodation Plans:(7)
    Campbell and Kennedy Electric (1996) Limited will develop a written process for the development of documented individual accommodation plans for employees with disabilities when required.

  10. Use of Assistive Devices:(8)
    Campbell and Kennedy Electric (1996) Limited understands that some individuals with disabilities require assistive devices for certain tasks or as a normal part of daily living. Accommodations will be made to ensure access is granted to all public spaces (e.g., reception, meeting rooms, washrooms accessible to the public, etc.) to the individual that requires the device.

  11. Use of Service Animals:(9)
    Campbell and Kennedy Electric (1996) Limited understands that some individuals with disabilities require assistive devices for certain tasks or as a normal part of daily living. Accommodations will be made to ensure access of the individual and his or her service animal is granted to all public spaces (e.g., reception, meeting rooms, washrooms accessible to the public, etc.). Campbell and Kennedy Electric (1996) Limited recognizes that refusal of a service animal is refusal of the individual themselves.

  12. Use of Support Individuals:(10)
    Campbell and Kennedy Electric (1996) Limited will accommodate both the facilitator and the individual with the disability at the highest extent possible and will not charge any fee for facilitators accompanying the employee or client.

  13. Planned or Unexpected Disruption of Accessible Services, Facilities, Amenities or Areas of Public Access:(11)
    Campbell and Kennedy Electric (1996) Limited will immediately notify and post the reason for disruption to accessible services, facilities, amenities, or public access areas including the anticipated duration of time and a description of alternative facilities or services if available.

  14. Feedback:(12)
    Clients and Campbell and Kennedy Electric (1996) Limited employees who may have a disability are encouraged to provide Campbell and Kennedy Electric (1996) Limited with feedback on Campbell and Kennedy Electric (1996) Limited’s ability to handle customer service or to address present issues or barriers in relation to accessibility. This feedback may be provided by means of telephone, e-mail, or fax to Campbell and Kennedy Electric (1996) Limited’s employer and will be responded to within 14 days in the same format that the feedback was provided unless requested otherwise.
    1) Any policy determined to not promote the dignity, respect, and independence of individuals with disabilities will be
    modified and/or removed.
    2) Any employee found to be in contravention to this policy will be subject to an investigation and have the potential for progressive disciplinary action, if necessary.

  15. Training:(13)
    Campbell and Kennedy Electric (1996) Limited will provide training to all existing and new employees on Ontario’s accessibility laws and on the Human Rights Code as it relates to people with disabilities. The training will be provided in a way most accessible to each employee in relation to each employee’s responsibilities. The training will include the following items of information:
    a) Overview of the Accessibility for Ontarians with Disabilities Act 2005 and the requirements of the Customer Service Standard,
    b) Campbell and Kennedy Electric (1996) Limited’s multi-year plan to address accessibility in the workplace (if exists),
    c) Conduct expected from Campbell and Kennedy Electric (1996) Limited employees when interacting with individuals who have a disability,
    d) Communication and interaction with individuals based on the type and severity of his or her disabilities,
    e) Interaction with individuals who use assistive devices, service animals, and/or facilitators
    f) Solving access issues for an individual that may experience difficulty accessing a public portion of Campbell and Kennedy Electric (1996) Limited’s premises.
